$25M Hydroxycut Settlement Denied In False Ad MDL

Law360, Los Angeles (November 19, 2013, 9:11 PM EST) -- A California federal judge on Tuesday declined to grant final approval of a $25.3 million settlement to resolve multidistrict litigation over recalled dietary supplement Hydroxycut products, finding that the $14 million cy pres distribution fund didn’t satisfy standards set forth by the Ninth Circuit.

The judge’s decision comes a year after class action plaintiffs in the false marketing suits asked the court to approve the settlement that would resolve the class actions but not individual personal injury suits that are also part of the MDL. The...
