Clear Choice Wants New Trial In TracFone Trademark Spat

Law360, Miami (February 29, 2016, 9:03 PM EST) -- Wholesale wireless provider Clear Choice Connections asked a Florida federal court Monday to overturn a jury verdict finding it infringed TracFone Wireless Inc.'s trademarks, arguing the website domain names it set up with the marks were used to sell genuine TracFone goods.

Clear Choice asked the court for a judgment as a matter of law or a new trial and said TracFone failed to show that there was any deception or confusion as to the marks because Clear Choice, as a TracFone dealer, was authorized to sell the products.
