It’s a good policy because it took 10 years for Gillespie and co-counsel Murray Klippenstein to reach a landmark, $16.5 million, mediated settlement with the Toronto Police Service in a class action launched in August 2010 over the mass arrest and detention of hundreds of largely peaceful protesters at the June 2010 G20 Summit in Toronto.

According to the provincial law society, lawyers in B.C. have raised concerns about the impact that the law society’s rule 3-58.1 (Trust account only for legal services) has had on retainers received by a lawyer who has been appointed as a mediator, arbitrator or parenting co-ordinator and who will be providing some incidental related legal services to the parties, such as the preparation of the mediation or arbitration (or related settlement) agreement.
