SEPARATION AND DIVORCE - Appeals and judicial review - Of final orders

Law360 Canada ( September 24, 2025, 9:37 AM EDT) -- Appeal by Wang from orders made in two related proceedings. The first proceeding was a family law action brought by Ms. Li against her then husband, Mr. Wang, in which Mr. Wang filed a counterclaim. The second proceeding was one brought by Ms. Li’s parents, Mr. Li and Ms. Peng against Mr. Wang. West Ask Investments Inc. (West Ask) was named as a defendant to the second action, in which the Li Parents alleged that West Ask, through Mr. Wang, misappropriated certain property. The two proceedings were heard together. West Ask was a party to both, given that certain of the claims in the family proceeding related to West Ask’s assets. A key issue on appeal related to the judge’s credibility findings regarding Mr. Wang which included that he consistently failed to provide the court with truthful answers to questions. Accordingly, the judge did not rely on Mr. Wang’s testimonial evidence and generally preferred the Li Family’s evidence over Mr. Wang’s where there was a conflict. Mr. Wang submitted that the judge made several significant errors in assessing his credibility and the credibility of the members of the Li Family. He claimed that these errors wrongfully disentitled him to any interest in most of what he considered to have been family property and resulted in his being found liable for misappropriation of funds and other property....
