F-1 Visa Holders Changing To H-1B Face New Risks

By Xavier Francis (May 9, 2018, 6:13 PM EDT) -- On March 20, 2018, U.S. Citizenship and Immigration Services announced it will temporarily suspend premium processing for all H-1B cap petitions for the fiscal year of 2019. This marks the second consecutive year USCIS suspended premium processing for H-1B cap petitions. Given the agency's limited resources and the high volume of H-1B petitions to adjudicate within a six-month period, it is not difficult to acknowledge the huge burden levied on the agency. This burden may also incentivize the agency to issue requests for evidence if it is unable to timely adjudicate those petitions. While the suspension of premium processing and RFEs affect many stakeholders, F-1 (student) visa holders may be exposed to more collateral harm in the long-run unless policy changes are implemented....
