NJ Judge Trims Claims In Class Suit Over Train Derailment

Law360, Los Angeles (October 4, 2013, 6:02 PM EDT) -- A New Jersey federal judge trimmed claims Friday in a consolidated class action against Consolidated Rail Corp. over a 2012 train derailment and chemical spill in New Jersey, but said a negligence claim could stand because the victims sufficiently alleged a duty of care.

U.S. District Judge Robert B. Kugler tossed three plaintiffs' claims, including an allegation that the rail company, Norfolk Southern Railway Co. and CSX Transportation Inc. — owners of the bridge where the train derailed — trespassed on their property through the spill....
