Texas Senate Passes Bill Blocking Local Fracking Ban

Law360, Houston (May 4, 2015, 5:35 PM EDT) -- The Texas Senate on Monday overwhelmingly passed a version of a House bill that would prevent local governments from imposing regulations like the Denton fracking ban, clearing the final hurdle before it is sent to the desk of Gov. Greg Abbott.

In a 24-7 vote, the Senate quickly approved H.B. 40, a bill to expressly preempt cities and other political subdivisions from regulating oil and gas operations and limit their ability to enforce setback rules that prevent wells from being drilled within a certain distance of schools and homes.
