Apple Seeks Redo After VirnetX's 'Outsized' $503M Patent Win

Law360 (November 20, 2020, 10:10 PM EST) -- Apple Inc. has urged a Texas federal judge to either override a $502.8 million jury verdict for infringing VirnetX's network security patents or order a new trial, arguing that no reasonable jury could have awarded such "outsized" damages.

In a motion filed Wednesday and unsealed Friday, Apple argued that VirnetX didn't present sufficient evidence to support the enormous damages award from October, which concluded a damages retrial held after a nearly identical award was thrown out on appeal. Apple argues that VirnetX didn't give evidence separating out Apple's profits and VirnetX's damages between the patented and unpatented features.
