TTAB Refuses 'Swiss Grills' Mark For Lack Of Intent

Law360, New York (September 14, 2015, 6:05 PM EDT) -- The Trademark Trial and Appeal Board has upheld an opposition by Swiss Grill Ltd. to its rival Wolf Steel Ltd.'s attempt to register the trademark "Swiss Grills" for barbecue and outdoor grills, finding Wolf Steel lacked the required bona fide intent to use the mark for those products prior to filing its registration application. 

In a precedential ruling issued Sept. 10, a three-judge TTAB panel held in part that Wolf Steel, at the time it filed its application, lacked real intent to use the mark in commerce for the products it identified.
