Homeservices of America, others get Florida home buyer's US antitrust claims dismissed

( July 15, 2025, 20:00 GMT | Official Statement) -- MLex Summary: Homeservices of America, BHH Affiliates, and HSF Affiliates have won dismissal with prejudice of Florida home buyer James Lutz's US antitrust complaint over an alleged conspiracy to require home buyers to pay fixed broker fees. The plaintiffs lack standing to pursue their claims as efficient enforcers of the antitrust laws, as their claimed injuries more indirect in comparison to other, more directly affected victims, US District Judge K. Michael Moore ruled in his order filed to Southern District of Florida. Further, the plaintiffs' claims should be dismissed on shotgun pleading grounds, as the complaint "asserts damages under twenty-five statutes, but fails to articulate, absent conclusory allegations, that Plaintiffs are entitled to relief under any statute," he said.See attached file....
