District Judge Mary Kay Vyskocil found that plaintiffs failed to plausibly define the market that EssilorLuxottica allegedly monopolized, attempted to monopolize, and illegally combined with others to restrain. Vyskocil said both sets of plaintiffs implausibly alleged that “[b]oth non-prescription and prescription sunglasses fall into the same relevant submarket,” even though prescription sunglasses serve the purpose of “vision correction” and non-prescription sunglasses do not.See attached file. ...
