AAI supports US appellate rehearing of Las Vegas hotel algorithmic price-fixing case

( October 9, 2025, 22:31 GMT | Official Statement) -- MLex Summary: The American Antitrust Institute told the US Court of Appeals for the Ninth Circuit that it erred in affirming the dismissal of price-fixing claims against Las Vegas hotels and Cendyn Group. AAI filed a brief in support of rehearing, arguing that a pricing software license can restrain trade in the market in which it prices products. “By holding that firms’ licensing agreements with third-party pricing software providers are “ordinary sale contracts” incapable of restraining trade in the relevant market, the panel opinion creates a rule that, in this circuit, competitors’ use of the same third-party pricing software provider is immunized from scrutiny under the antitrust laws regardless of any alleged anticompetitive effects,” it said.
