ByteDance, TikTok Inc. ask US court to dismiss antitrust lawsuit by US investors

( August 6, 2025, 21:53 GMT | Official Statement) -- MLex Summary: ByteDance and TikTok Inc. told a US federal judge that an antitrust lawsuit brought by a group of American investors fails at every level because the plaintiffs lack standing and the defendants did not cause any redressable injury. The complaint also fails to state a claim as it alleges no harm to competition. In a motion to dismiss the complaint filed in the Southern District of Florida, the defendants said the complaint should be dismissed with prejudice as the plaintiff’s principal Brad Greenspan is a "vexatious litigant who has already had three pleading opportunities." The complaint fails to invoke any plausible theory of an antitrust violation, and the plaintiffs use buzzwords like “market allocation,” “bid rigging,” “concerted refusal to deal” and “group boycott” but fail to allege that defendants and their alleged co-conspirator Oracle are horizontal competitors. Oracle is a cloud-storage provider and its relationship with the defendants, if any, is vertical, not horizontal, the filing said.See attached document....
