Nippon Steel says consumers' US merger challenge merits dismissal

( October 10, 2025, 19:55 GMT | Official Statement) -- MLex Summary: Nippon Steel further argued its motion to dismiss steel consumers' amended US merger challenge over its deal with US Steel, telling a federal judge that the plaintiffs have not addressed any of the defects the court identified over Article III standing and injury. The steel consumers, instead, argue that Article III "somehow does not apply to them" and that traceability of alleged injury to the merger itself is not a strict requirement; they argue that it is more than sufficient to allege that they would be threatened by an increase in steel product prices, Nippon Steel said in its reply in support of dismissal filed to the Northern District of California. But plaintiffs plead no facts demonstrating how the merger will cause steel prices to rise, nor how those steel prices will then raise prices products containing steel, the filing said.See attached document:...
