Appeals against RWE’s side of E.On asset swap rejected by EU’s top court

( June 26, 2025, 08:23 GMT | Official Statement) -- MLex Summary: German energy suppliers including EVH and EnergieVerbund Dresden today lost their appeal at the EU’s top court against the bloc’s merger approval for RWE’s acquisition of power-generation assets from E.On. The deal formed part of an asset swap between RWE and its rival E.On, both sides of which are subject to litigation at the Court of Justice. This court today rejected five of the nine appeals brought against RWE’s side of the deal, dismissing their argument that the European Commission should have reviewed the two parts of the swap together as a “single concentration.” As regards the other four appeals, the court said these were “inadmissible,” as the companies hadn’t shown that their market position was affected by the deal.Statement follows.
