IHS Insists Tribe Provide Health Services To All Members

Law360, New York (November 22, 2016, 7:24 PM EST) -- The Indian Health Service has told the chairman of the Nooksack Indian Tribe that the tribe must continue to provide health services to all its members under its contract with the agency, including hundreds of members the tribe has tried to disenroll.

IHS Portland area director Dean M. Seyler said in a letter to Nooksack Chairman Robert Kelly Jr. dated Nov. 18 that the tribal council’s efforts to disenroll as many as 331 members of the tribe appear to have been made without a sufficient quorum on the tribal council and in violation of the tribe's constitution and bylaws.
