Kohl’s Hit With Class Action Over Applicant Screenings

Law360, New York (June 11, 2015, 3:18 PM EDT) -- Kohl’s Department Stores Inc. allegedly used ambiguous and misleading language to obtain credit reports from job applicants in violation of the Fair Credit Reporting Act, according to a proposed class action complaint filed in California federal court Tuesday.

Named plaintiff Kayonie Coleman alleges Kohl’s performed illegal background and credit checks on her prior to her employment with the retailer between October 2012 and June 2013. Coleman asserts that Kohl’s employment application conceals the authorization for these background checks within heaps of impenetrable legalese.
