La. Plaintiffs Score Appeal In FEMA Trailer MDL

Law360, New York (October 26, 2010, 2:19 PM EDT) -- The federal judge overseeing multidistrict litigation over allegedly toxic trailers provided to hurricane victims has granted the plaintiffs’ interlocutory appeal of a May ruling that freed the U.S. government of negligence under Louisiana law.

On Monday, Judge Kurt D. Engelhardt of the U.S. District Court for the Eastern District of Louisiana cleared the way for the plaintiffs’ steering committee to get the appeals court’s word on whether Louisiana plaintiffs can sue the U.S. government for negligence under the Federal Tort Claims Act in connection with the...
