MINUTE ENTRY for proceedings held before Magistrate Judge Marcia M. Henry: A video initial conference was held on 06/30/2026. Alex Folkerth, Darryl Alvarado, Ashley Price, Erin Boardman, and Jack Scott appeared on behalf of the Plaintiffs. Daniel Schwartz and Brian Weinstein appeared on behalf of the Defendants Clarivate PLC, Stead, Hanks Archbold, Ahmed, Roy, Lomholt-Thomsen, Samson, Von Blucher, Gilis, Iyer, Macksey, Munk, Bomba, Neral, Roedel, Alberola, Cortas, Levyn, White. Karim Basaria and Bruce R. Braun appeared on behalf of Defendant Pricewaterhousecoopers LLP. Billy Marsh and Dennis Kitt appeared on behalf of Defendant Citigroup Global Markets, Inc.
The Clerk of Court is respectfully directed to update the caption of this action to "Pension Trust Fund for Operating Engineers, et al. v. Clarivate PLC et al." and to terminate Defendants Onex Corporation, Baring Fund Entities, The Baring Asia Private Equity Fund VI, L.P.1, the Baring Asia Private Equity Fund VI, L.P.2, and Elgin Investment Holdings Limited (the "Fund" Defendants). (See 03/30/2026 Mem. & Order, ECF No. 124 at 1 n.1 & 24-32)
For the reasons stated on the record, (1) Defendants' request for leave to file a sur-reply opposing class certification (see ECF No. 142 at 4) is denied without prejudice and with leave to renew and (2) the parties' respective requests for a class certification briefing schedule (see id. at 1-4) are denied. The Court reserved decision on the parties' proposed protective order (see ECF Nos. 143 & 144).
By 07/14/2026, (1) the parties shall meet and confer and file a revised proposed discovery plan with the amendments to the class certification briefing schedule discussed on the record; (2) the parties shall file a proposed ESI protocol; and (3) Plaintiffs shall move to withdraw any counsel of record that no longer represent Plaintiffs.
By 09/30/2026, the parties shall file a joint status report (not exceeding three pages) on their progress with discovery, and settlement discussions.
