Plaintiff, an inmate in the York County Jail, has filed a motion seeking appointment of counsel (Doc. No. 2), a motion seeking leave to file an amended complaint (to be drafted after the plaintiff consults with appointed counsel) (Doc. No. 3), and a motion asking the court to serve defendants (Doc. No. 4). Plaintiff has not yet complied with the May 16, 2024 Order (Doc. No. 13) regarding payment of the filing fee or filing an application for in forma pauperis status. And this court has not completed its preliminary review of the original complaint, see 28 U.S.C. § 1915A. This court cannot determine at this preliminary stage whether there would be fundamental unfairness if counsel were denied, see DesRosiers v. Moran, 949 F.2d 15, 23 (1st Cir. 1991); whether any amended complaint that could be drafted would be properly filed; and whether service of the complaint must be directed upon any defendants. Accordingly, the pending motions (Doc. Nos. 2, 3, 4) are denied as premature, without prejudice to plaintiff's ability to seek similar relief after plaintiff complies with the May 16, 2024 Order (Doc.
