Bankruptcy Appeal (801) | New Jersey
Order
TEXT ORDER: This appeal was noticed on 9/7/23. D.E. 1 . The Record on Appeal was designated on 10/26/23. D.E. 2. On 11/3/23, the Court granted Appellant's unopposed motion seeking an extension to file its appellate brief from 11/13/23 to 1/30/24. D.E. 5 . On 1/26/24, the Court granted another unopposed motion by the Appellant seeking a further extension until 4/30/24. D.E. 7 . On 4/11/24, Appellant sought a further unopposed extension, which the Court denied. D.E. 9 . Appellant filed its brief on 4/30/24. D.E. 11 . Now Appellee moves unopposed for a two-month extension of its time to file its opposition from 5/30/24 to 7/30/24 citing ongoing "complex settlement discussions." D.E. 16 . The Court notes that the parties have had significant time since the appeal was noticed to engage in settlement discussions. The Federal Rules of Bankruptcy Procedure must be administered to secure the "just, speedy, and inexpensive determination of every case and proceeding." Fed. R. Bankr. P. 1001 (emphasis added). In consideration of the foregoing, the Court GRANTS an extension for Appellee to file an opposition until 6/13/24. Appellee may request a short further extension if needed for good cause shown and with a status update to the Court. So Ordered by Judge Evelyn Padin on 5/14/2024. (bt)
