ORDER DEFERRING RULING on 52 in case 2:25-cv-05023; GRANTING 53 in case 2:25-cv-05023; and GRANTING 52 in case 1:25-cv-05571. This discovery dispute is premature. As set forth in the 1/12/2026 scheduling order, Judge Shields ordered only "Tier I" discovery consisting of certain contracts prior to a decision on defendant's motion to dismiss. If the Court schedules a premotion conference on this discovery dispute at a later time, the Cement and Concrete Workers plaintiffs may participate.
Counsel is again reminded that any filing pertaining to both 25-cv-5571 and 25-cv-5023 shall be made by initiating the filing in the lead case 25-cv-5023 and choosing the option that will appear to "spread" the filing to the member case 25-cv-5571.
