MINUTE entry before the Honorable Iain D. Johnston: The Court has reset the deadline for the plaintiff's Federal Rule of Civil Procedure 7.1(a)(2) disclosure twice, but the plaintiff has yet to file one. When the Court reset the deadline the second time, it also directed plaintiff's counsel to read all of Rule 7.1, to certify in writing that he had done so, and to file a Rule 7.1(a)(2) disclosure. The Court also warned that failing to do so by 5/28/2024 would result in dismissal under Rule 41(b). To date, the plaintiff has still not filed a Rule 7.1(a)(2) disclosure, and plaintiff's counsel has not filed the required certification. The Court issues a Rule to Show Cause why this case should not be dismissed under Rule 41(b) for the plaintiff's repeated failure to comply with this Court's orders to file a Rule 7.1(a)(2) disclosure plus counsel's failure to file the required certification. A hearing on the Rule to Show Cause will be held on 6/5/2024 at 3:30 PM. Plaintiff's counsel must appear in person; defense counsel may participate by telephone and will receive instructions on how to do so the day before the hearing.
