Memorandum of Conference
MEMORANDUM OF CONFERENCE AND ORDER CONCERNING SEALED AND REDACTED VERSIONS OF SUMMARY JUDGMENT FILINGS. The Court convened a teleconference with counsel for all parties and counsel for the United States in light of counsel for the United States' motion for a telephone status conference. Doc. # 589 . After hearing from counsel, the Court agreed with the view of the United States that it should have an appropriate opportunity to review and assert the government's Tuohy security/confidentiality interests with respect to public disclosure of any summary judgment documents that are filed by the parties. None of the parties stated any objection to allowing the United States to conduct a review of their sealed summary judgment filings so that the United States may assert any interests it may have against the subsequent public disclosure of particular information or documents that are contained within the parties' summary judgment filings. The Court's prior order (Doc. # 588 ) denying the defendants' motion to seal afforded the parties' an additional seven days after their sealed filings of their summary judgment papers to file proposed redacted versions of their filings. It is apparent, however, that it will take substantial additional time for the United States to conduct an appropriate review and to assert any confidentiality interests that it may have beyond those asserted by the parties. After further discussion with counsel, it was agreed that the appropriate way forward will be for each party to promptly disclose to counsel for the United States its sealed summary judgment filings and then, after consultation with the United States and all other parties, for each party to file a redacted version of their summary judgment filing within 60 days of the date of the sealed filing (subject to further extension on good cause motion). The Court therefore MODIFIES its prior order (Doc. # 588 ) in two ways: (1) to authorize disclosure by each party to counsel for the United States of their sealed summary judgment filings, and (2) to allow each party 60 days from the date of their sealed filing to file a redacted version of their summary judgment filing on the public record docket, accompanied by a motion to seal and memorandum that establishes compelling reasons to support limited sealing and that establishes that the proposed scope of sealing is narrowly tailored to serve those reasons. As the Court noted during its teleconference with counsel, this order does not modify the deadlines for the parties to file the sealed versions of their summary judgment papers, does not place any limitation on the information or documents that any party may file on the docket under seal to support their summary judgment arguments, and does not require any party to seek pre-clearance from the United States before filing their sealed summary judgment papers. It is so ordered.
