ORDER The above-referenced action has been referred to me for settlement purposes. (Dkt. 167.) Counsel for defendant John Piccarreto has informed the Court that he is in the process of contacting his client, who is incarcerated at FCI McKean, to discuss plaintiff's settlement proposal, and hopes to speak to his client next week. It is hereby ORDERED that, no later than May 31, 2024, defendant Piccarreto's counsel must file a status letter, updating the Court as to whether he has discussed settlement with his client, and - if he has not yet done so - when he expects to speak to his client. Scheduling Order
SCHEDULING ORDER: The parties shall appear for in-person oral arguments on the pending motions to dismiss Alixs Amended Complaint, ECF Nos. 328 & 332, on Wednesday, May 29, 2024, at 3:15 p.m., in Courtroom 1105 of the Thurgood Marshall Courthouse, 40 Centre Street, New York, New York. The parties should be prepared to discuss, among other things, the following issues as further set forth in this Order. No later than a week before the scheduled hearing, the parties shall send a joint email to Chambers indicating which attorneys intend to present oral argument. If the scheduled date and time are not feasible for any party, they shall promptly - and no later than May 21, 2024 file a letter motion seeking rescheduling and indicating proposed alternate dates and times that work for all parties in the days surrounding the currently scheduled hearing.
