Law360 Canada ( June 3, 2025, 1:23 PM EDT) -- Appeal by appellant Blanke against the Corporation of the District of West Vancouver (District) regarding its issuance of development and building permits to individual respondents, David and Deborah Wolfin (Wolfins). The properties in question were subdivided with development permits issued in 2012 for similar homes on both lots. The Wolfins purchased their property in 2017 and obtained a new development permit in 2018, which was later renewed in 2023 due to delays caused by the COVID-19 pandemic. The appellant purchased his property in 2019, was aware of the Wolfins’ 2018 permit. He owned the property adjacent to the Wolfins. He later contested the Wolfins’ renewal, and the minor changes approved in 2023. He challenged the decisions made by the District’s Director of Planning and Development Services, claiming the Director exceeded his authority and breached procedural fairness by not providing notice or consultation opportunities. The appellant argued that the 2018 permit was issued without proper authority and that the 2023 renewal and minor changes were unreasonable. The chambers judge found, however, that the Director acted within his delegated authority and that the 2018 permit was valid. The chambers judge also determined that the appellant lacked standing to challenge the 2018 permit, as he was not the property owner at the time of its issuance....
