A Texas federal judge on Friday tossed a lawsuit alleging Bayer Schering Pharma AG defrauded Medicaid by touting off-label uses for contraceptive drugs Yasmin and Yaz, saying a supposed whistleblower was not the original source of the claims because they were previously reported by Law360 and other news outlets.

A pharmaceutical company watchdog accused Bayer Schering Pharma AG of marketing its Yasmin and Yaz contraceptives for unapproved purposes and causing doctors to seek Medicaid reimbursements for off-label prescriptions of those drugs, according to court documents unsealed Monday.
