The Third Circuit on Wednesday denied a bid by pharmaceutical company Eisai Inc. to have the full court revisit a panel's earlier decision not to revive an antitrust suit against Sanofi-Aventis U.S. LLC over the anticoagulant Lovenox.

Pharmaceutical company Eisai asked the full Third Circuit on Wednesday to revisit the company's bid to revive an antitrust suit against Sanofi, arguing that the panel set a harmful precedent for consumers by allowing Sanofi to enter arrangements with hospitals that effectively excluded competition for the anticoagulant Lovenox.

Pharmaceutical manufacturer Eisai Inc. on Tuesday asked the Third Circuit to reinstate its antitrust lawsuit against Sanofi-Aventis U.S. LLC over discount contracts with hospitals that purchased large amounts of its anticoagulant drug Lovenox, arguing the company improperly worked to raise the price of competitors.
