The U.S. Department of Health and Human Services and the state of Georgia have reached a settlement in a D.C. Circuit case over whether the federal government must refund $75 million in mistaken Medicaid payments, even though the time limit for claims had passed, the parties said Wednesday.

The federal government has told the D.C. Circuit that a lower court was wrong to conclude that the U.S. Department of Health and Human Services must refund Georgia $75 million in mistaken Medicaid payments, arguing the state can’t overcome the fact that the two-year window for making claims has expired.
