Princess Cruises Ltd. cannot escape a widow's wrongful death suit alleging it failed to warn the woman's husband of a COVID-19 outbreak on a ship, the Ninth Circuit has ruled, finding the company is unable to show the man contracted the virus outside U.S. waters.

The widow of a man who died after allegedly contracting COVID-19 while on a Hawaiian cruise urged the Ninth Circuit on Tuesday to revive her suit against Princess Cruises, saying her husband didn't contract the disease on the high seas so her state law claims for wrongful death damages aren't preempted.
