The U.S. Securities and Exchange Commission said Monday that two dialysis company executives accused of accounting fraud should not be allowed to tell a jury about a Milbank LLP-led internal investigation they say found no evidence of intentional wrongdoing.

Three former financial executives of dialysis company American Renal Associates Holdings Inc. must face U.S. Securities and Exchange Commission claims they cooked the company's books by more than $39 million in 2017 and 2018, a Boston federal judge has determined.
