An attorney for a CVS Health consumer on Thursday urged a Ninth Circuit panel to reverse a lower court's order denying class certification in a suit alleging the retail giant misled consumers on the effectiveness of its hand sanitizers, saying the lower court fundamentally misunderstood an expert's report.
