The U.S. Supreme Court declined on Monday to review a split Third Circuit ruling that Rutgers University students cannot challenge the school's COVID-19 vaccine policy because, under the high court's 1905 precedent in Jacobson v. Massachusetts, there is no fundamental right to refuse vaccinations.

The Third Circuit on Thursday upheld the dismissal of a lawsuit by Rutgers University students who challenged the school's COVID-19 vaccine policy, with the majority finding that, under the U.S. Supreme Court precedent in Jacobson v. Massachusetts, there is no fundamental right to refuse vaccinations.

Counsel for a group of Rutgers University students told the Third Circuit on Tuesday that the school did not have the authority to require its students to be vaccinated against COVID-19 in order to attend classes, calling the policy unconstitutional because of the vaccine's "experimental" nature.
