The U.S. Department of Health and Human Services told the Fifth Circuit that a suit over Title X, which was argued in November, should be dismissed because the plaintiff in the case is believed to no longer have a child under the age of 18, making it moot.

A Fifth Circuit panel on Monday pressed the U.S. Department of Health and Human Services on whether the agency's Title X program that provides confidential contraception to minors violates a Texas father's constitutional rights to parental consent and found it "very strange" the father wouldn't have that right.
