The Fourth Circuit on Monday ruled it won't give another shot to a North Carolina doctor and his partner at suing a medical center for $1.4 million over a sale deal gone awry after finding that their fraud settlement with the government in a separate matter precluded their contract claim.

The U.S. government and state of North Carolina have urged the Fourth Circuit to reject a bid by a doctor and his wife seeking damages and attorney fees related to an alleged breach of contract, saying that the couple made the same arguments in a different case that was dismissed.
