LabMD Inc. urged the Eleventh Circuit on Wednesday to revive its suit alleging the Federal Trade Commission conducted an illegal investigation on the lab and wrongly initiated a civil prosecution against it using a doctored file, arguing the district court wrongly found the case was untimely and barred by sovereign immunity.
