A Texas federal magistrate on Monday advised against dismissing Pacira Biosciences Inc.'s suit against a rival, finding that Pacira had alleged enough facts to show QuVa Pharma Inc.'s advertising is deceptive in a suit over the former company's compounded drug for pain.

Pharmaceutical company Pacira BioSciences Inc. is looking to stop rivals from marketing their so-called generic versions of its non-opioid based drug used to manage post-surgery pain, claiming in three separate lawsuits that the companies falsely advertise their medications as qualifying for an exemption to federal regulatory approval.
