The Ninth Circuit in a published order Tuesday said the lawyer of the co-founder of a Montana ski resort must pay opposing counsel's attorneys' fees and costs totaling about $200,000 for bringing a "frivolous and bad-faith appeal" of a twice-rejected bid to disqualify a bankruptcy judge.

The Ninth Circuit on Tuesday sanctioned the co-founder of a Montana ski resort and his lead counsel for bringing a frivolous appeal of a twice-rejected bid to disqualify a bankruptcy judge, saying the lead attorney has a "propensity for distortion" and acted unprofessionally throughout the proceedings.
