9th Circ. Won't Rethink Ruling Against Tribal Bingo Website
The Ninth Circuit on Wednesday said it won't rethink a circuit panel ruling that backed a lower court's decision to shut down the Desert Rose Bingo website, rejecting the Iipay Nation of Santa Ysabel's contention that its site didn't violate the Unlawful Internet Gambling Enforcement Act.

The federal government and California jointly urged the Ninth Circuit on Friday to reject the Iipay Nation of Santa Ysabel's request that the appellate court rethink its ruling affirming a lower-court decision that shut down the tribe's online bingo website, saying the ruling didn't overlook the facts or the law.

The Ninth Circuit on Thursday upheld a lower court ruling that shut down the Iipay Nation of Santa Ysabel's online bingo site, saying the operation violated the Unlawful Internet Gambling Enforcement Act because bets were placed off the California tribe's lands and that it wasn't shielded by the Indian Gaming Regulatory Act.

Calif. Tribe Says Fed. Gaming Law Doesn't Block Online Bingo
The Iipay Nation of Santa Ysabel pressed the Ninth Circuit on Monday to rule that the tribe's online bingo complied with federal law, saying the federal government and the state of California can't point to any part of the Indian Gaming Regulatory Act that specifically requires customers to be physically on Indian lands when they're playing the game.

Calif. Tribe's Internet Bingo Is Legal, 9th Circ. Told
A California federal judge was wrong to find that Iipay Nation of Santa Ysabel's online bingo flouted federal law when he ruled in favor of state and federal bids to curtail the website because Iipay gaming laws allow bingo players off tribal lands to participate over the Internet, the tribe told the Ninth Circuit Wednesday.
