Wells Fargo can amend its coverage suit against Fidelity National Title Insurance Co. over defense costs of underlying litigation involving a property foreclosure sale, the Ninth Circuit has ruled, saying the bank can potentially introduce new coverage evidence.

Fidelity National Title Insurance Co. asked the Ninth Circuit to reject Wells Fargo's bid to amend its complaint, saying the court should ignore an earlier case against it in which a lower court reversed its ruling after another bank provided new coverage evidence.

Wells Fargo and HSBC asked the Ninth Circuit during oral argument Wednesday to find that their title insurer must cover the costs of defending their interests in properties sold in homeowner association foreclosure sales, saying a Nevada district court incorrectly held no coverage was available.
