A western Missouri town can't skip out on a suit brought by AT&T over a 175-foot cell tower that the tech behemoth was denied permission to build because it was too ugly after a federal judge said he doesn't buy the town's argument that he can't make them approve the application.

A small city straddling the Missouri-Kansas border claimed a proposed wireless tower wouldn't have "even come close to conforming to the city's zoning laws" and again asked a Missouri federal court to throw out a suit from AT&T fighting the rejection of the tower.
