    8th Circ. Sends ND Smoking Ban Row Back To Tribal Court

    An Eighth Circuit panel on Monday overturned a preliminary injunction that kept three North Dakota tribes from seeking action in tribal court against a gas and oil exploration company over a smoking ban dispute, saying a district court's ruling was premature and that all remedies haven't been exhausted in the Native American court system.
