Money Tree Capital Markets LLC asked a New York federal judge Wednesday to dismiss a lawsuit from a lender alleging the company owes $10 million from a line of credit, saying the lender conducted the transaction with "eyes wide open."

Lender Money Tree Capital Funding LLC has told a New York federal judge that it's trying to recover more than $10 million that it says it's owed from a line of credit it extended to borrower Money Tree Capital Markets LLC, claiming that it's been intentionally shut out of receiving information about 23 mortgage loans made from the line of credit.
