Commercial Real Estate Exchange Inc. said its appeal of previously dismissed counterclaims deserves to advance so that the Ninth Circuit can hear the merits of why its antitrust counterclaims against competitor CoStar were sufficiently pled.

CoStar asked the Ninth Circuit this week to toss Commercial Real Estate Exchange Inc.'s appeal of its dismissed counterclaims, contending that there's overlap with the property information giant's pending copyright claims, CREXi's pending trademark counterclaims and the axed antitrust counterclaims.
