A Colorado federal judge has put an end to long-running litigation accusing a pair of gas companies of underpaying royalties, saying the facts that previously led the court to dismiss the claims have not changed.

A pair of gas companies is again asking a Colorado federal court to toss claims that they owe royalty payments to Phelps Oil and Gas LLC, saying the facts that led the court to dismiss the case in 2019 have not changed and that judgment should be reinstated now that the Tenth Circuit has returned the case to federal court.

A putative class of natural gas interest owners seeking allegedly unpaid royalties will have to try to make their case in the same Colorado federal court that decided against them on summary judgment three years ago before the Tenth Circuit sent the case back to state court because the amount in controversy appeared too small.
