ERISA Official Tells 9th Circ. Insurer Can't Recoup Payment
An ERISA benefits plan administrator told the Ninth Circuit that a trial court improperly ordered it to forfeit about $300,000 that its insurer mistakenly overpaid for coverage of a $5.7 million arbitration award, saying the lower court applied the wrong coverage cap.
