The Fifth Circuit rejected an Allstate unit's request for a rehearing Monday in a coverage dispute over a policyholder's roof damage, after a three-judge appeals panel found that a Texas federal court failed to take into proper account the policyholder's expert's testimony.

A hail coverage case is heading back to trial court after a Fifth Circuit panel reversed an insurer's win, finding a Texas federal judge wrongly disregarded testimony from the policyholder's expert who said the homeowner's roof was not only subjected to excluded cosmetic damage but also functionally impaired.
