Progressive Insurance secured another class certification reversal in a lawsuit over certain adjustments the insurer makes when calculating the actual cash value of a totaled vehicle, and one of the carrier's attorneys praised the Fourth Circuit for finding that the issues at hand are individualistic in nature. The Seventh Circuit on Thursday reversed a policyholder's class certification win against Progressive Insurance over certain adjustments the insurer makes when calculating a totaled vehicle's actual cash value, finding that whether Progressive paid insureds the proper amount is a primarily individualized inquiry.

Some Seventh Circuit judges seemed unsure Thursday that a group of Progressive insureds should be allowed to pursue class claims over allegedly improper cash valuations for totaled vehicles, saying the class would likely struggle to prove each of their contracts were breached.
