Order on Motion to Intervene Order on Motion for Leave to File
MINUTE ORDER. The court is in receipt of Movant T&R Chemicals, Inc.'s 7 motion to intervene. Under Federal Rule of Civil Procedure 24, "[o]n timely motion, the court may permit anyone to intervene who . . . has a claim or defense that shares with the main action a common question of law or fact." Fed. R. Civ. P. 24(b). That standard has been met. This proceeding concerns a subpoena served by T&R Chemicals, Inc., and T&R Chemicals, Inc. shares an interest with Petitioner in seeking to establish the validity and the enforceability of the subpoena. Moreover, despite the court's order directing Respondent to file a status report indicating its position on the motion, Respondent did not file the required status report or otherwise oppose the motion. See Minute Order (July 6, 2026). Accordingly, the 7 motion to intervene is granted. The court also grants Movant T&R Chemicals, Inc.'s 14 motion for leave to file a reply in support of the International Trade Commission's petition to enforce subpoenas to American Fruits and Flavors, LLC.
