MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 5/15/2024. By Judicial Assistant: E. Santiago.
Pending before the Court is the Stipulation to Continue Settlement Conference (ECF No. 86 ). The Court set this conference on April 29, 2024. The Court was not alerted by Defendants to a conflict with this date until May 14, 2024, despite the fact that the client representative and counsel should have been aware of the conflict on the day the Order was issued, if not soon thereafter. The Court has limited days available for settlement conferences. Moving settlement conferences at the last minute ensures no one gets the benefit of available dates as it is virtually impossible to coordinate multiple parties' schedules on short notice (such as one week before a date suddenly becomes available). While the Court is sympathetic to emergencies, the parties in this case do not demonstrate emergent circumstances.
The above said, the Court will grant the request on this occasion, but further continuances will not be granted absent exigency. The Nevada Attorney General's Office is put on notice that requests of this nature may be denied in the future. The Court advises counsel to alert the Attorney General's Office to the content of this Order.
Accordingly, IT IS HEREBY ORDERED that the Stipulation to Continue Settlement Conference (ECF No. 86 ) is GRANTED.
IT IS FURTHER ORDERED that the settlement conference currently set for May 22, 2024 is vacated and rescheduled for August 20, 2024 at 9:00 a.m. No further continuance of this date will be granted absent exigent unforeseen circumstances.
IT IS FURTHER ORDERED that the confidential settlement briefs are due in chambers on August 13, 2024. Delivery must be made electronically to Emily_Santiago@nvd.uscourts.gov. Except as stated herein, the prior terms of the April 29, 2024 Order (ECF No. 85 ) remain in full force and effect.
